Athlema respects the intellectual property rights of others, and we expect the people who use Athlema to do the same. This Copyright Policy is part of our Terms of Service. It explains how to tell us about content on Athlema that you believe infringes your copyright, and what to do if your content was removed by mistake. It follows the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

In this policy, "Athlema", "we" and "us" mean Athlema, Inc..

Send copyright notices and counter-notices to our Designated Copyright Agent:

Athlema, Inc., Attn: Copyright Agent (mailing address available on request at legal@athlema.com)

Email: copyright@athlema.com

Phone: available on request at copyright@athlema.com

Our agent is designated with the U.S. Copyright Office, and the same details are filed in its DMCA Designated Agent Directory.

Email is the fastest way to reach us. This address is only for copyright notices and counter-notices. For other questions, use support@athlema.com or athlema.com/contact.

If you believe content on Athlema infringes a copyright you own or are authorized to act for, send our Copyright Agent a written notice that includes all of the following:

  1. Your physical or electronic signature. Typing your full name is enough for an electronic signature.
  2. A description of the copyrighted work you believe has been infringed. If your notice covers several works, a representative list of them.
  3. A description of the content you believe infringes, and where it is on Athlema, with enough detail for us to find it. For example, the link to the photo or page, or the player, team, pickup game or program it appears on.
  4. Your contact information: your name, mailing address, phone number and email address.
  5. A statement that you have a good-faith belief that the use of the content in the way you describe is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If your notice does not include all of these, we may not be able to act on it.

3. What we do when we receive a notice

When we receive a notice that meets the requirements above, we act quickly to remove or disable access to the content. We tell the person who posted the content that we removed it. We may send them a copy of your notice, including your name and contact information, so that they can contact you or send a counter-notice.

4. How to send a counter-notice

If content you posted was removed because of a copyright notice, and you believe it was removed by mistake or misidentified, or that you have the right to use it, you can send a counter-notice to our Copyright Agent. Your counter-notice must include all of the following:

  1. Your physical or electronic signature. Typing your full name is enough for an electronic signature.
  2. A description of the content that was removed or disabled, and where it appeared on Athlema before it was removed.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of a mistake or misidentification of the content.
  4. Your name, mailing address and phone number.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, of any judicial district in which Athlema may be found, and that you will accept service of process from the person who sent the original notice or that person's agent.

5. What we do when we receive a counter-notice

When we receive a counter-notice that meets the requirements above, we send a copy to the person who sent the original notice and tell them that we will restore the content in 10 business days. We then restore the content not less than 10 and not more than 14 business days after we received the counter-notice, unless our Copyright Agent first receives notice that the person who sent the original notice has filed a court action seeking an order to stop you from engaging in the infringing activity on Athlema.

6. Repeat infringers

We close the accounts of people who repeatedly infringe copyrights, in appropriate circumstances. We may also limit or remove access to Athlema for anyone who infringes others' intellectual property rights, whether or not they are a repeat infringer.

7. Do not send false notices

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that content is infringing, or that content was removed by mistake or misidentification, may be liable for damages, including costs and lawyers' fees. If you are not sure whether content infringes your copyright, for example because it may be a fair use, please talk to a lawyer before sending a notice.

8. Trademarks and other rights

This policy is for copyright only. If you believe content on Athlema infringes your trademark or another intellectual property right, or misuses your name or image, write to legal@athlema.com with the details, and we will review it.

9. Changes to this policy

We may update this policy from time to time. We will post the new version on this page and update the "Last updated" date.
